EU ska granska Apple Pay och App Store

EU-kommissionen har meddelat att de nu kommer att dra igång två separata utredningar mot Apple gällande konkurrensbrott. I de båda utredningarna ska EU undersöka om Apple har missbrukat sin dominerande ställning på marknaden för appar och mobilbetalningar via sina tjänster App Store och Apple Pay.

I App Stores fall handlar det om att företag som till exempel Spotify, som anmälde Apple till EU förra året, måste betala 30 procent av sina intäkter från köp som görs inuti i appar till Apple. Om detta säger EU:s konkurrens-chef Margrethe Vestager i ett uttalande:

"It appears that Apple obtained a ‘gatekeeper’ role when it comes to the distribution of apps and content to users of Apple’s popular devices. We need to ensure that Apple’s rules do not distort competition in markets where Apple is competing with other app developers, for example with its music streaming service Apple Music or with Apple Books. I have therefore decided to take a close look at Apple’s App Store rules and their compliance with EU competition rules."

När det gäller Apple Pay så har Apple tidigare anmälts till EU för att de inte låter konkurrerande tjänster för mobilbetalningar använda iPhones NFC-funktioner, något som gett dessa en klar nackdel jämfört med Apple Pay. Om detta säger Vestager:

"It appears that Apple sets the conditions on how Apple Pay should be used in merchants’ apps and websites. It also reserves the ‘tap and go’ functionality of iPhones to Apple Pay. It is important that Apple’s measures do not deny consumers the benefits of new payment technologies, including better choice, quality, innovation and competitive prices. I have therefore decided to take a close look at Apple’s practices regarding Apple Pay and their impact on competition."

Apple säger i ett uttalande att man är besvikna på att EU har valt att lyssna på ett litet antal företags "grundlösa klagomål" mot företagets tjänster. I ett uttalande säger Apple:

"Throughout our history, Apple has created groundbreaking new products and services in some of the most fiercely competitive markets in the world. We follow the law in everything we do and we embrace competition at every stage because we believe it pushes us to deliver even better results.

We developed the App Store with two goals in mind: that it be a safe and trusted place for customers to discover and download apps, and a great business opportunity for entrepreneurs and developers. We’re deeply proud of the countless developers who’ve innovated and found success through our platform. And as we’ve grown together, we’ve continued to deliver innovative new services — like Apple Pay — that provide the very best customer experience while meeting industry-leading standards for privacy and security

At the end of the day, our goal is simple: for our customers to have access to the best app or service of their choice, in a safe and secure environment. We welcome the opportunity to show the European Commission all we’ve done to make that goal a reality."

Skulle EU-kommissionen bedöma att Apple brutit mot EU:s konkurrensregler kan man dra Apple inför domstol, något som skulle kunna bli jättedyrt för Apple om man skulle dömas där. EU har möjligheten att båda förbjuda tjänster som bedöms bryta mot EU:s konkurrenslagar och även utdöma böter på upp till 10 procent av ett företags årsomsättning. I Apples fall skulle det i värsta fall kunna resultera i böter på 5,67 miljarder euro i böter, motsvarande nästan 60 miljarder kronor, baserat på Apples omsättning för 2019.
